Terms and Conditions of Use
1. Acceptance of Terms
By accessing or using the Accessibility Professionals Association (hereinafter referred to as "APA") Forums (hereinafter referred to as the "Forums"), you agree to be bound by these Terms and Conditions of Use (hereinafter referred to as the "Terms"). If you do not agree to these Terms, you are not authorized to use the Forums. Â
2. Purpose of the Forums
The Forums are intended to provide a platform for members and other interested parties to discuss topics related to accessibility, share information, ask questions, and engage in community discussions.
3. User Responsibilities
By using the Forums, you agree to:
- Comply with all applicable laws and regulations.
- Respect the opinions and views of other users.
- Refrain from posting content that is unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, discriminatory, or otherwise objectionable.
- Not post any content that infringes upon the intellectual property rights of others.
- Not post any spam, advertisements, or solicitations without the express written consent of the APA.
- Not impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity. Â
- Not upload or transmit any viruses, malware, or other harmful code.
- Be solely responsible for the content you post on the Forum.
4. Disclaimer of Responsibility for Content Validity
You acknowledge and agree that the Accessibility Professionals Association (APA) does not actively monitor, verify, endorse, or guarantee the accuracy, completeness, reliability, or validity of any information, advice, opinions, statements, or other content posted by users on the Forums. The APA assumes no responsibility for the content posted by users and shall not be liable for any errors, omissions, or misrepresentations in such content, or for any loss or damage of any kind incurred as a result of your reliance on such content.
Users are solely responsible for evaluating the accuracy and usefulness of any information, opinions, advice, or other content available through the Forum. Any reliance you place on such content is strictly at your own risk.
The APA does not provide professional advice through the Forum. Information shared on the Forums should not be considered a substitute for professional consultation or guidance.
5. Moderation and Removal of Content
While the APA is not responsible for the validity of user-generated content, the APA reserves the right, but has no obligation, to monitor the Forum and to remove or edit any content that violates these Terms or that the APA, in its sole discretion, deems inappropriate or harmful. The APA is not responsible for any failure or delay in removing such content.
6. Limitation of Liability
To the fullest extent permitted by applicable law, the APA, its officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your use of or inability to use the Forums, or any content posted on the Forums, even if the APA has been advised of the possibility of such damages. Â
7. Indemnification
You agree to indemnify, defend, and hold harmless the APA, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Forum or your violation of these Terms.
8. Modification of Terms
The APA reserves the right to modify these Terms at any time without prior notice. Your continued use of the Forums after any such modifications constitutes your acceptance of the revised Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
10. Entire Agreement
These Terms constitute the entire agreement between you and the APA with respect to the Forums and supersede all prior or contemporaneous communications and proposals, whether oral or written. Â
